Terms of Service

1. Acceptance of Terms
By accessing or using HammerDash ("the Service"), operated by HammerDash, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
HammerDash is a financial management platform for US owner-operators and small trucking fleets. The Service provides expense tracking, IFTA tax calculation, per diem tracking, invoicing, load profitability analysis, and AI-powered tools. HammerDash is not a licensed CPA, tax advisor, or financial institution. All calculations, reports, and estimates are provided for informational purposes and should be reviewed by a qualified tax professional before filing.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Subscription Plans & Billing
- Free Tier: Limited functionality with usage caps (e.g., 2 receipt scans, 1 IFTA calculation).
- Solo Plan ($29/month or $290/year): Full features for a single owner-operator.
- Fleet Plan ($79/month or $790/year): Multi-truck support with advanced features.
Subscriptions are billed in advance on a monthly or annual basis through Whop (our payment processor and merchant of record). Whop handles all payment processing, tax collection, and compliance. Prices are in US dollars. Applicable taxes (VAT/sales tax) are calculated and collected by Whop based on your location. We reserve the right to change pricing with 30 days' notice.
5. Refund Policy
- Monthly plans: You may cancel at any time. No refunds are issued for partial months. Your access continues until the end of the current billing period.
- Annual plans: You may request a full refund within 14 days of purchase if you have not used the Service beyond basic account setup. After 14 days, no refunds are issued. You may cancel at any time and your access continues until the end of the annual period.
- Downgrades: If you downgrade from a paid plan to free, access to paid features continues until the end of your current billing cycle.

6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to facilitate fraud
- Attempt to reverse-engineer, decompile, or disassemble the Service
- Interfere with the Service's infrastructure or other users' access
- Upload malicious content, viruses, or harmful code
- Share your account credentials with unauthorized parties
- Resell or redistribute the Service without written permission
7. Data & Your Content
You retain ownership of all data you upload to HammerDash (receipts, financial records, trip data, etc.). We do not sell your data to third parties. We use your data solely to provide and improve the Service. See our Privacy Policy for details on data handling.
8. AI Features Disclaimer
HammerDash uses AI for expense categorization, receipt scanning, tax estimates, and chat assistance. AI-generated results are not guaranteed to be accurate. You are responsible for reviewing and verifying all AI-generated data before using it for tax filings, financial decisions, or regulatory compliance.
9. IFTA & Tax Disclaimers
IFTA calculations, Schedule C mappings, quarterly tax estimates, and per diem deductions provided by HammerDash are estimates only. They do not constitute tax advice. You are solely responsible for the accuracy of your tax filings. We strongly recommend consulting a CPA or tax professional before filing.
10. Limitation of Liability
To the maximum extent permitted by law, HammerDash, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from temporary unavailability.
12. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your account settings. Upon termination, your data will be deleted within 30 days unless retention is required by law.
13. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 15 days before they take effect. Continued use of the Service after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Fulton County, Georgia.
